Fibonacci is operated by Maria Alegre Ribas ("we", "us", "the seller"). By creating an account or continuing to use the service, you agree to these terms and confirm you are an adult with the authority to agree to them, including on behalf of children whose profiles you create.

Fibonacci is a math practice app for children. Parents create child profiles, children practise times tables and mental math, and parents can view progress in the parent dashboard. We grant you a limited, non-exclusive, non-transferable right to use the service for your own family, within the plan you choose.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation and refund mechanics are governed by Paddle's Buyer Terms (https://www.paddle.com/legal/checkout-buyer-terms). Subscriptions renew automatically at the price shown at checkout until you cancel; you can cancel any time and keep access until the end of the period you paid for.

You must not misuse the service. That means no unlawful use, no fraud or spam, no infringing anyone's intellectual property, and no interfering with the security or operation of the service — including introducing malware, probing vulnerabilities, or scraping content. You must not reverse engineer, resell or redistribute the service, or circumvent its technical limits.

You must keep your account credentials and parent code confidential; you are responsible for activity under your account. You must provide accurate information (such as your children's names and ages) and keep it updated. You retain ownership of the information you enter; you grant us a limited licence to host and process it solely to provide the service.

We retain all ownership of the service and its intellectual property, including the software, the Fibonacci brand and logo, the question content and the documentation. These terms do not transfer any of it to you.

We work to keep the service reliable, but we do not guarantee it will be uninterrupted or error-free. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

To the fullest extent permitted by law, we are not liable for indirect, consequential or special damages (including loss of profits, data or goodwill), and our total liability is capped at the fees you paid in the 12 months before the claim. Nothing in these terms limits liability for fraud, death or personal injury where the law does not allow it.

We may suspend or terminate access for material breach of these terms, non-payment, security or fraud risk, or repeated or serious violations of our policies. When access ends, you may ask us to export or delete your family's data by emailing hello@fibonaccigames.app; we delete or anonymise data that is no longer needed.

You may not assign these terms without our consent; we may assign them in connection with a merger or acquisition. We are not responsible for failures caused by events beyond our reasonable control. These terms are governed by the laws of Spain, and disputes will be handled by the courts of the seller's jurisdiction, except where consumer law gives you the courts of your home country.
